| 农村集体建设用地使用权分为为公共事业或公益事业而使用集体土地、为农民个人非营利目的而使用集体土地和为工商业营利目的而使用集体土地3种情形。农村集体建设用地使用权的取得为继受取得,取得集体建设用地使用权要受到主体、地块和使用目的的限制。农村集体建设用地使用权进入市场流转,是市场经济发展的必然趋势,也是优化土地资源配置的必然要求。 |
