    摘要:

    国有企业为了进一步解决企业内部人员冗余、产品成本中人工费用过高等问题,实施了"减员增效",以促进其进一步发展.不少企业纷纷采取了与职工"有偿解除劳动关系"的做法,但由于目前国家并没有出台专门的法律法规来规范与指导企业的这一行为,在此过程中也出现了不少问题,尤其是引发了经济补偿金的问题.所以,应统一我国关于经济补偿金的相关法律法规,企业也必须慎重处理.

    Abstract:

    In order to further solve the problems in surplus workers in state-owned enterprises (SOEs) and in higher human cost of production and so on, the state-owned enterprises implement the policy of "reducing the number of workers to improve the benefit" to promote further development of the SOEs. Many enterprises use the policy "to terminate the working relation with the surplus workers by economically compensating the workers", but, currently, Chinese Government has not had any specific laws and regulations to standardize and guide this behavior of the enterprises, there are a lot of problems, especially economic compensation funds, in this process. Thus, the related laws and regulations about economic compensation funds should be unified and the problem should be carefully solved by the enterprises.
