    摘要:

    技术调查官的任职与管理制度决定了技术调查官队伍的稳定和发展,是查明技术事实的核心。如何选任及管理是有技术调查官制度的国家关注的内容。如日本、韩国、中国台湾地区对技术调查官都规定了严格的任职条件,并主要采用任期制的方式作为法院的工作人员。我国各个知识产权法院规定了技术调查官的管理办法,但任职条件不同,管理制度缺失。为了促进技术调查官制度的发展,应统一从必要条件和禁止条件规定任职条件,分别管理不同类别的技术调查官,如以专业技术公务员序列管理、考核专职人员。

    Abstract:

    The administration of technical investigator affects the stability and development of this system and is the key to investigating technical problem, and how to select and manage the technical investigators is the focused contents of the countries with technical investigators system. Many countries and regions such as Japan, Korea and Taiwan have very strict qualification for technical investigator and treat them as staffs in the court in their official term. Although intellectual property courts in China put some regulations into force, it is still lack of administration system. In order to develop the system, we need to give strict qualification for technical investigator and manage them in different types. Full time technical investigators are treated as technical civil servants
