The use of orphan works is closely related to the construction of the digital libraries.Many countries actively make legislation on the orphan works to improve the cultural competition and the public interest in the digital age.China’s third copyright law amendment also adds the orphan works system，but the central licensing mode is not suitable for mass digitization of the digital libraries.Therefore，the extended collective licensing is necessary to ensure the legal certainty and reduce the licensing costs.
