Abstract:The mortgage system of Chinese rural land contract management might play an important role in production management activity and financial and economic life of Chinese rural areas. In rural land management right mortgage, the mortgagor who hope to get subject qualification should meet the following conditions: mortgagors must be persons with full capacity for civil acts or the ability of production and management in the agricultural sector without poor credit records; Contractors have made clear to contract-issuing party about issues of mortgage; To obtain the rural land contracted management right mortgage by lawful transfer,and make the contracting party agree that the contracted land management can be used for mortgaging and transferring legitimately. The object of the managerial contracting of rural land is the right of management, and the subject matter is rural land itself. Registration is both the essential element to resist Chinese Rural Land Contracting Management Right and the requirements of validity of the mortgage of Chinese Rural Land Contract Management Right. The law must Establish Right of preferential repurchase of mortgagor when the mortgage of Chinese Rural Land Contract Management Right is fulfilled. Land use should not be arbitrarily changed. In case the purpose of land use needs to be altered,the change should be carried out according to law.
