    摘要:

    建筑物区分所有权的剥夺系对违反义务的业主所采取的最为严厉的措施,这一制度在德国、日本和我国的台湾地区均有相关规定,我国《物权法》未规定这一制度。但在现实生活中,存在着业主私自拆除承重墙等严重危害建筑物安全的行为,仅靠现行法律规定的法律责任无法规制和惩罚上述行为,以保障其他业主的人身财产安全。建筑物区分所有权的剥夺这一制度具有可借鉴性,我国立法若将其引入,能够完善我国立法的不足。

    Abstract:

    The deprivation of Searated property ownership’s right is the most severe measure which is used for the owner who breaks the obligation.There are relevant laws in Germary,Japan and Taiwan region of China.There is not relevant laws in Property law of China.But in the real life,there are some behaviors which are hamful to safety such as the removal of walls and so on.It doesn’t regulate and punish those behaviors relying on the esisting legal provisions in order to protect the safety of owners’ human and property.It is a significant to introduce this kind of system because it is advantageous to perfect our legislation.
