    摘要:

    从司法领域中涉及公权力案件的和解制度启示入手,论述了在和谐社会背景下,允许学校与学生就处分尺度等问题和解,应当是一个有意义的设想。并从价值哲学、辩证法与实践论三个方面分析了要不要选择学生申诉和解制度;从结构与功能论的角度分析了应当怎样构建学生申诉和解制度。

    Abstract:

    Based on reconciliation system of public rights cases in judicial field, this paper discusses that under the background of harmonious society, the schools are allowed to reconcile students punishment, analyzes whether appealing and reconciliation system of students punishment should be chosen from three perspectives such as value philosophy, dialectic method of analysis, practicability and expounds how to construct appealing and reconciliation system from the angle of structure and function.
