网络消费的发展促使网上支付的产生,由此第三方支付平台成为网上支付的一个模式。而第三方支付平台的合法性却令人怀疑,第三方支付平台作为一个从事代理收付款等业务的网络消费支付中介机构,其经营主体资格、经营行为均缺乏充足的法律依据。可以从第三方支付平台经营主体资格、经营行为两方面探讨第三方支付平台的合法性,并从准入机制、监管机制等方面完善第三方支付平台。
