辩诉交易与被害人

    摘要:

    为了提高诉讼效率,某些刑事案件确需辩诉交易。但若不经被害人同意强行进行辩诉交易,就会违背刑诉的正当目的。为防止提升诉讼效率而过度牺牲公正和过度追求形式公正而背离实质公正,应在立法上明确规定并在执法中充分保障被害人的辩诉交易权,使其与公诉权、辩护权相制衡,以实现各主体间利益平衡。
