    摘要:

    认为符合用途管制是集体土地入市的前提与市场起决定作用,就必须要素自由入市之间争议激烈,导致多数矿业用地的用途管制不严。“前提论”与“自由论”的争议,在于管制对象与区域的非同一性。根据物权状态二元结构以及市场二元结构法,明晰用途管制的对象与范围:土地利用与产业市场。政府守在产业市场入口处审查土地利用的资格,未取得“门票”者禁止投入矿业开发。政府管制土地利用权利束中的土地发展权是守卫者和仲裁人而绝非参与主体,政府管制在于弥补市场不足而非取代市场功能。

    Abstract:

    Land use control is a discussion between collective landing marketing and libertarian marketing, resulting in majority of lax mining land use control. “On the premise” and “on Libertarian” controversy is based on nonidentification of object and region. According to the dual structure of real rights and dual structure of market, the object and region of land use control are clarified: land use in the industrial market. Government controlled its entrance of industrial market, and prohibited the mining development investment. Government controlled the land use rights and land development rights, and this control changes the output structure, but government is still an arbitrator rather than participator. Government regulation is to make up the deficiency of the market rather than replace the market function.
