Abstract:The author’s moral rights experience the development trend from nonexistence to existence in international copyright law and their demonstrated changing process means the emphasis on the personality interests of the authors and the protection of human right value by international society. After the position of the moral rights of the authors in copyright law changes, the moral rights are regulated and amended by the laws and regulations of all countries, but their appellations, level and contents are not completely identical, and China’s legislation on the protection of copyright transcends the standard of Berne Convention. Under the conditions of the new media technologies, the economic value of the moral rights is gradually highlighted, trying to get ride of the restriction of the existed theories and to develop towards economic rights, therefore, the position of moral rights in copyright law has gradually expanded and has exceeded the limits itself and has taken a superior seat.
