日本经济法因其特殊的历史背景在诞生之日起便突破了传统经济法危机对策法的定位,形成了一系列的赶超型的法律制度.反思中国经济法,特殊的时期与特定的原因给予其改革先锋与代位法的历史使命,却在市场的不断完善中日益呼唤其赶超型法律的崭新定位.
