实现司法正义是司法独立与司法监督共同追求的价值。然而 ,司法独立与司法监督在操作技术层面上却有着尖锐的对立和冲突。在司法独立的基础上实现有效的司法监督 ,在司法监督中保障司法独立 ,是法治追求的理想境界。在法律程序领域 ,程序的正当过程以及它的公开与开放、抗辩与交涉、分化与制衡等运作特点 ,将二者有机地兼容起来 ,从而使司法独立与司法监督在程序中实现了和谐
