| 摘要: |
| 犯罪构成是我国犯罪论及刑法学的基石性理论范畴。从原初的意义上考察,犯罪构成兼具刑法和刑事诉讼法的双重功能属性。由于外在观念和内部构造的双重因素,长期以来犯罪构成被仅从实体刑法的角度加以研究,从而导致其程序机能的弱化。由此,应对现行犯罪构成体系进行结构性改进,建立犯罪构成的实践模式,恢复其对刑事司法实践的导引功能,并推动刑事一体化理念在实践层面的展开。 |
