| 基层治理的“法治化”本身蕴含善治价值取向,基层善治价值共识旨在表达关于“法治化”制度运行的“共同感”其实现的核心逻辑是生成基层治理共同体的伦理精神。这种伦理精神的内核呈现为党政群团以实现共同富裕为目标的权力为民、各类协同组织公益互助的凸显、自治组织的“共参共商”以及个体的家国同心。借鉴制度构成要素的划分,促成上述图景的“法治化”制度应当以价值性与“技术性”相统一为原则““综合性”地完成如下建构:嵌入文化-认知性要素,以中华优秀传统文化中“日用而不觉”的共同价值观念为涵养:彰显规范性要素,以自由、平等、公正为统摄全面贯彻社会主义核心价值观,并据此推进制度的系统衔接:统筹规则性要素,缜密策划实体规定与程序规定。而且,三者交叠的建构过程须秉持以文化-认知性要素为始基的立场。 |

| The “ rule of law” in grassroots govermance inherently implies a value orientation toward goodgovemmance. The value consensus of grassroots good governance aims to express a “sense of commonality"reugarding the operation of the “ rule of law” system. The core logic of its realization is to generate the ethical spiriof a grassroots governance community. 'The core of this ethical spirit is manifested in the following aspects: theParty and government, as well as mass organizations , aim for common prosperity through power for the people;the prominence of collaborative organizations in public welfare and mutual aid: the “ co-participation and coconsultation” of self-goverance organizations; and the unity of individuals’family and national interestsDrawing on the division of institutional elements, the “ rule of law” system that promotes the above vision shouldfollow the principle of integrating value-oriented and technical considerations, and comprehensively construct thefollowing : embedding cultural-cognitive elements, nurtured by the common value concepts in excellent traditional Chinese culture that are “ unconsciously used in daily life” ; highlighting normative elements, comprehensively implementing the core socialist values with freedom , equality, and justice as the overarching principles, ancaccordingly advancing the systematic integration of institutions; and coordinating regulatory elements, meticu |
