| “监管沙盒”是促进金融科技发展、缓和法律滞后性的创新性金融监管方式。 其中,退出制度
作为“监管沙盒”的闭环制度是其核心内容,而持续测试企业承诺制度则是完善和丰富退出制度的重要
内容。 构建持续测试企业承诺制度,首先应解决其适用范围问题。 基于此,我国应从顶层设计出发,通过
立法控制与执法裁量规则,制定概括性条款对持续测试企业承诺制度的适用范围进行初步规制,并给予
监管机构自由裁量权;再通过反面排除与正面适用规则对持续测试企业承诺制度的适用范围进行具体规
制;最终形成一套自上而下、张弛有度的持续测试企业承诺制度确立规则,科学且完善地对持续测试企业
承诺制度的适用范围进行限制。 |

| Abstract: |
| “Regulatory sandbox” is an innovative way of financial supervision to promote the development
of financial science and technology and alleviate the lag of law. Among them, the exit system, as a closed-loop
system of “regulatory sandbox”, is its core content, while the continuous testing of enterprise commitment sys_x005ftem is an important content to improve and enrich the exit system. To build a continuous testing enterprise commitment system, we should first solve the problem of its scope of application. Based on this, China should start
from the top-level design, formulate general provisions through legislative control and law enforcement discretion
rules, preliminarily regulate the scope of application of the continuous testing of enterprise commitment system,
and give the regulatory authority discretion. Secondly, through the negative exclusion and positive application
rules, the scope of application of the continuous testing of enterprise commitment system is specifically regulated. Finally, a set of top-down continuous testing enterprise commitment system with good flexibility will be
formed, and the rules will be established to limit the scope of application of the continuous testing enterprise
commitment system scientifically and perfectly. |
