| 近年来,知识产权“三合一”模式改革取得一定成效也存在一些问题。在大数据等网络技术应用日益广泛的大背景下,知识产权犯罪案件逐年增长,呈现网络化、智能化、跨区域化等犯罪新态势。检察机关作为法律监督机关和司法机关,应从办案实践中的诸多薄弱点出发,结合大数据、云计算等数字技术来研判知识产权犯罪新趋势、破解惩防困境及举证维权的难题。在刑事司法中严格遵循利益平衡的执法理念,运用大数据技术来强化知识产权案件司法效率,建立两法衔接,证据固定、涉案金额查验的多方协作机制,构建权利人和执法机关多部门协作预防和维权的联动机制。 |

| In recent years,the reform of the“three-in-one”model of intellectual property rights has made certain achievements but there are still some problems.Under the background of the increasingly widespread application of network technologies such as big data,intellectual property crime cases have been increasing year by year,showing a new trend of criminalization such as network,intelligence and cross-regionalization.As a legal supervisory organ and judicial organ,the procurator organ should use digital technologies such as big data and cloud computing and so on to explore new trends in intellectual property crimes,solve the dilemma of punishment and prevention,solve the problem of defending rights from the weak points in case handling,strictly abide by law enforcement concept for the balance of interests,strengthen the judicial efficiency of intellectual property cases by using big data technologies,establish a convergence of the two methods,fixed evidence,and multi-party cooperation mechanism for checking the amount involved and construct a linkage mechanism for the prevention and protection of the rights between multi-departmental rights holders and law enforcement agencies. |
