| 终身保修协议是独立的无名合同，实践中过于简单的约定使其常表现为“条款待定的合同”。基于“鼓励交易”的精神应推定该类合同成立，并通过合同解释填补合同漏洞。在没有明确约定的情况下，“终身”应为针对不同类型产品在质量合格正常使用情况下确定的一般使用寿命，使用寿命从产品购买之日起计算。“保修”在没有约定为无偿的情况下应为有偿，除已约定仅收取维修所需零配件费用外，应按照当时进行此类维修的市场价格来确定维修费用。 |

| The lifetime warranty agreement is an independent unnamed contract, and the contract assumption is often too simple in practice with terms deliberately left open. There should be a presumption of establishment of contract based on the spirit of “advocating bargain”, and through the contract interpretation to supplement the loopholes in the contract. In the absence of a clear agreement, the “lifetime” should be determined according to the service life in general of different products in the quality qualified under normal use, and the starting date is the date of purchase.“Warranty” in the absence of clear agreement should be paid in accordance with the market prices, except having already agreed that only need to pay the fee of parts needed for maintenance. |
