| 对1990—2010年相关统计数据的实证分析显示，我国司法腐败呈现出渎职化、高端化、权力寻租组织化、经营化、长期化等外在特征和司法体制过度行政化的内在特征。预防司法腐败的基本构架应当包括四个方面：相对独立的司法制度体系，以程序正义为核心的诉讼体系，以检察权为核心的司法内部监督体系和廉洁自律的职业伦理体系。 |

| Abstract: |
| Empirical analysis based on related statistical data during 1990—2010 indicates that China’s judicial corruption has the external characteristics of dereliction of duty, high side power, right rent seeking organization, administrative business and long term business and so on and has the inner characteristics of excessive administration of judicial system. The basic framework for preventing judicial corruption should include such four aspects as relatively independent judicial system, litigious system by taking procedural justice as core, judicial monitoring system by taking prosecutorial power as core and professional ethnic system with clean and self discipline. |
