| 由于缺少法律的有效调整，如何在确保高校学生实习权的同时使学生的人身权得
到保障一直是一个难以解决的问题。 在现阶段$片面强调对实习企业课以过高的义务不具有
现实操作性，此时学校应当承担起更多的责任，但从应然层面上看，企业应当尽到相应的社会
责任，对实习学生的人身伤害应承担起无过错责任。 同时国家应及时将这种道义责任上升为
法律责任。 |
