| 基于服务合同与物型合同的重大差别，有必要在未来的民法典中采纳广义服务合同概念并借鉴《欧洲法通则服务合同》立法模式对服务合同做出类型化规范。在服务合同中应着重规定服务合同的概念、服务提供者的先合同警告义务及合同中警告义务、服务提供者的 注意义务标准、服务提供者和客户间的相互协作义务、客户的随时解除权与损害赔偿权。 |

| Abstract: Based on the great difference between the services contracts and goods-type contracts, it is necessary to take the broad definition on service contract and take reference of the legislation mode Of the Principles of European Law on Services Contracts in our making of Civil Code of China. In the legislation, we shall especially make rules on the definition of services contract, the pre-contractual & contractual duty of the services providers to warn. the general standard of care for services, duty to corporate, termination right of the client at any time and right to damages. |
