| 域名在网络经济时代具有巨大的商业价值，因此各种形式的域名权纠纷层出不穷。如何对域名进行有效的保护，预防和解决域名权纠纷，成为网络环境下必须面对的新问题。重点探讨如何通过法律手段解决域名权纠纷:首先从域名的相关概念及其作用入手，通过介绍两种关于域名权的主流学说，引出作者所赞成的观点——知识产权说。在此基础上，通过分析域名纠纷的典型案例，比较了当前世界各国保护域名权的相关法律规定,并对我国域名权保护的现状进行了介绍。最后，尝试提出对域名权进行法律保护的相关对策。 |

| Domain name has enormous commercial value at the network economy era, so various kinds of domain name disputes arise. How to protect the domain name effectively, prevent and resolve the domain name dispute has become the new problem that we must face. This paper focuses on how to resolve the domain name dispute through the law. Firstly, this paper shows the related concept and role of the domain name and then introduces two mainstream theories about the domain name which leads the “intellectual property rights doctrine” that the author is in favor of. Secondly, this paper compares the relevant laws and regulations for the protection of the domain name right in the entire world through the analysis of a typical case of domain name disputes, and introduces its current status in China. Finally, this paper tries to put forward the right policy for the legal protection of the domain name right. |
