| 我国现行国家赔偿标准一律采用抚慰性标准,不能有效遏制、预防公权力违法,不能有效保障人权。惩罚性国家赔偿标准具有确立的必要性,也有其可行性。在建构惩罚性赔偿标准时,要处理好惩罚性赔偿标准与其他赔偿标准的关系、受害公民与纳税人利益平衡的关系等七个相应关系、问题。 |

| Current China's state compensation standard only uses consoling standard and can not effectively suppress and prevent public rights from breaking the laws and can not effectively protect human rights.It is necessary and feasible to establish punitive state compensation standard.Construction of punitive compensation standard should rationalize the relationship between punitive compensation standard and other compensation standards and the relationship between victims and the balance of the interests of taxpayers. |
