| 非物质文化遗产的法律保护日益受到重视,是国家实施知识产权战略的重要内容。以著作权保护非物质文化遗产的同时,可采用商标权保护模式,促进文化资源向经济效益的转换,实现对非物质文化遗产的综合保护。商标法应当将非物质文化遗产纳入其保护范围,明确非物质文化遗产可以作为证明商标或集体商标申请注册。 |

| The legal protection of immaterial cultural heritage is more and more paid attention to and is an im- portant content for China to implement intellectual property right strategy.While copyright is used to protect immaterial cultural heritage,trade mark protection mode can be used to promote the change from cultural re- sources to economic benefit to realize comprehensive protection of immaterial cultural heritage.Trade mark law should protect immaterial cultural heritage and should state that immaterial cultural heritage can apply for reg- istration as certification marks or collective marks. |
