| 居住权是传统大陆法系国家民法典中人役权的一种。在西法东渐时,我国并未采纳该制度。而在物权立法的早期讨论中,也鲜有人提及。但近年来,随着对物权法草案讨论的深入,居住权制度受到了学者们的广泛关注。在实践中,亦存在因为居住问题引起的纷争。因此,在当前有必要对居住权制度进行深入的分析和讨论。 |
