| 债权凭证制度的出台曾一度被认为是医治“执行难的良方”,但是由于债权凭证制度缺乏法律依据,剥夺了当事人依法享有主张利息的权利,还在实施中增加了法院的工作量。其在实施过程中引发了不良社会效果,所以有必要坚决摒弃这一制度,重塑执行中止制度,使执行中止严格依法进行。 |
