| 构建和谐社会是一项庞大而复杂的社会系统工程,涉及方方面面观念的转变和制度的更新。安定有序以及公权与私权的良性互动是和谐社会的内在特征,这些特征与刑法所具有的社会保护及人权保障功能产生了交集。因此,和谐之美必然包含刑法底蕴。在和谐社会的语境下,一些传统的刑法观念与和谐社会尊重和保护人权的时代要求格格不入。反思传统观念,树立新型观念,对于和谐社会的构建意义深远。 |
