| 在级别管辖中涉及牵连管辖时上级法院吸收下级法院管辖权可能导致那些本不应受到重刑处罚的被告受到重刑的威胁。级别管辖中的管辖权在上下级法院之间的转移导致司法权行使的行政化,违背了司法权的行使规律,并且由于管辖权行使的行政化使得诉讼当事人被排除在管辖权决定的程序之外,不利于诉讼当事人权益的保障。 |
