| 摘要: |
| 在当前国际贸易中,设立WTO环境贸易规则是环境保护的需要,但WTO环境贸易规则同时制造了贸易的壁垒和障碍。绿色贸易壁垒的出现源于对环境保护价值取向的不良利用。WTO环境贸易规则在环境保护语境下,应当保持其维持贸易自由的作用,但同时应当考虑贸易与环境的关系的微妙之处,从而健全其规则的利益代表的广泛性,在伦理理性和实践合理性之间充分地平衡,才是克服局限的有益出路。环境保护、绿色壁垒的目的理性的有限性问题的解决进路是伦理合理性和实践合理性之间关系的合理化。 |
