| 有限政府要解决日益扩大的行政事务,必须借助于政府以外的力量,行政权运行过程中引进市场机制就是在这个背景下发生于公共行政领域的一种变革。政府职能内部市场化、政府职能非行政化、公用事业民营化、政府参与市场运作是行政权运行过程中引进市场机制的突出表现。目的的公共政策性、手段的市场性、意思表示的政府主导性、适用范围的有限性、法律适用的综合性是行政权运行过程中引进市场机制的主要特征。为使市场机制在行政权运行过程中更好地发挥其功能优势,必须从适用范围、审查制度、公共产品供给的评估制度、法律责任等方面加强法律规制。 |
