| 不动产是否适用善意取得,因各国对登记效力规定不一而不同。但从人的互相尊重、交易安全及第三人的利益保护角度来看,不动产善意取得制度是其他法律制度所无法替代的。在我国民法典起草中,应以登记公示推定力与公信力为基础,构建不动产善意取得制度,从而完善我国的交易安全保护制度。 |
