| 考察现有各国立法,判例和学说,可以发现现代合同法与侵权法相互融合、边界模糊化趋势,这一趋势具有相应的表现和合理的原因,该趋势是债法应对社会变化做出的自我调整,其目标是指向正义这一至高的法律价值,而其进一步发展和制度协调也将在正义法律价值的引导下展开. |
