| 行政权力与公民权利是行政法的核心,在不同的国家与社会背景下,行政权力与公民权利之间也呈现出不同的关系形态.市民社会背景下政治国家与市民社会既分立又相互渗透,行政权力与公民权利也在相互渗透.由于行政权力和公民权利都可能被滥用,因此二者的相互渗透既有积极渗透又有消极渗透. |
