摘要:

随着最高人民法院全面收回死刑核准权,对死刑复核程序的改革与重塑已成为理论界与实务界关注的焦点。检察机关介入死刑复核程序,发挥其作用对理论和司法实践都有着深刻的指导作用。检察机关介入死刑复核程序应坚持双重身份,同时履行刑事追诉职能和法律监督职能。通过赋予检察机关死刑复核程序启动权,最高人民检察院行使死刑复核案件的启动、支持公诉、审判监督等职能,介入死刑复核程序,最终实现维护司法公正、尊重和保护人权的目的。
