目前,学界对法律逻辑的学科性质众说纷纭,莫衷一是。归纳起来,主要有形式逻辑分支论、应用逻辑分支论和理论法学分支论3种。在我国,虽然理论法学分支论最近才有个别学者以模糊的语气谈及,并且一经提出便遭到许多学者的质疑,但经过分析,就会发现,理论法学分支应该是法律逻辑的最佳归宿。
