| 在物权法的研究和制定过程中,浮动抵押制度以其不可抵挡之势出现在学者和立法者面前,该制度在我国的移植已成为无法回避的问题。分析了严格浮动抵押的设定;赋予抵押权人相应的权利,以防止抵押人滥用权利;明确了浮动抵押权人与其他债权人的受偿次序。 |
