| 法律概念是在人们的生活方式不断更新的过程中,立法者在法律调整中对欲规范事物所具有的各种特征的基础上,根据某种立法意图、规范意旨所规定的最基本的法律思维形式,是对欲规范事物在一定阶段上的兼顾社会心理的理性总结和定位。法律概念不断生成的过程是法律预见性和参与性的过程。作为法律思维的最基本单位,法律概念使法律法规系统成为一个开放的系统。这既是社会伦理、法律发展的需要,也是人类理性认识发展的需要。 |
