Abstract:Rural college students are a special group under the urban-rural dual system. Due to the difficulty in fulfilling the non-agriculturalization of household registration, occupation, regular residence and the difficult performance of the rights and obligations of rural areas, their collective membership qualifications are challenged or even denied, causing their rights and interests of their previously contracted land violated. The survey results show that, under “the separation of two rights”, the proportion of female students who did not get the contracted land before attending the universities is higher than that of male university students, that the land right and interests violation in male university students after attending the universities is positively correlated with their household register migration, that the land right and interests violation in rural female university students after attending the universities is positively correlated with their age, and that the possibility in the land right and interests violation of rural university students in developed area is higher than that of undeveloped area. Under “the separation of three rights”, “the identity of collective organization member” and “the identity of rural family member” of the university students from rural area should be clarified, i.e., the university students from rural area should equally share all kinds of rights and interests from their contracted land with other rural peasants and share all kinds of rights from their contracted land with their other family members. In the period of their contracted land and including its extending period, no matter how the identity of the university students changes if they are still the citizens of People’s Republic of China, the governments should not coercively take back their management rights of their contracted land, meanwhile, the benefit from the contracted land transfer of the students should be really guaranteed by ensuring the land for the students and by ensuring the rights for the students, in addition, the rights and interests of the students who did not get the contracted land before attending universities should be really guaranteed.
