| 认识技术与制度变迁的一般规律对于我们理解历史,清晰地把握未来的制度选择和制度安排具有主动性和先导性.通过对技术、制度及其变迁的基本理论的介绍和分析得出其对法律制度建设的若干启示,即:由于技术进步所推动的诱致性法律制度变迁往往需要政治权力的拉升才能完成,因此,立法者要及时洞悉其特点和变化,促成立法目标的实现. |
